Membership Subscription Terms

These terms and conditions apply to all subscriptions for annual membership to www.minigalleryworld.com including free trial memberships. By subscribing to membership of www.minigalleryworld.com you accept our terms and conditions.

The terms "you" and "your" refer to you, the applicant for subscription for membership or existing subscriber to membership of www.minigalleryworld.com. "We", “us” and "our" refer to www.minigalleryworld.com, 'Mini Gallery', Hazel Semple and Chris Storey. We are independent parties and this agreement will not form any partnership.

This website, www.minigalleryworld.com, is owned and maintained by Hazel Semple and Chris Storey trading as 'Mini Gallery' of 4 Bassett Court, Bassett Avenue, Southampton, SO16 7DR . In the event of queries contact Hazel Semple and Chris Storey at enquiries@minigalleryworld.com.

MEMBERSHIP ELIGIBILITY

Mini Gallery membership at www.minigallery.co.uk is open to self-representing British artists only. Mini Gallery membership at www.minigalleryworld.com is open to self-representing artists in the USA, Canada, Australia and New Zealand only. British artists who are members of www.minigallery.co.uk automatically appear at www.minigalleryworld.com. Professional and amateur artists aged 16 years of age and over may apply. Mini Gallery is specifically designed for individual artists and we do not deal with applications from any third parties such as artists' agents.

MEMBERSHIP APPLICATIONS

Artists are given 2 (two) weeks to complete their online membership applications. If after 2 (two) weeks an application has not been completed it shall be deleted and a new application must be started.

Artists who successfully complete the online membership application form are given a 7 (seven) day free trial period with access to their own Mini Gallery. At the end of the free trial period artists shall have 4 (four) weeks in which to purchase an annual membership subscription. If after 4 (four) weeks an artist does not purchase an annual membership subscription his or her Mini Gallery and application shall be deleted.

Artists who have been given a free trial period shall not be eligible to reapply for a period of at least 6 (six) months.

USAGE

We are committed to maintaining a family friendly website and to this end we will monitor the content of all mini galleries submitted. All mini galleries are therefore subject to approval prior to them appearing on the live website and we reserve the right to edit or remove any item subsequently added.

QUALITY OF CONTENT

The quality of artwork photographs is paramount. All artwork entries including photographs are reviewed for quality before appearing on the live website. We reserve the right to disallow poor photographs and / or inappropriate material from being displayed.

MEMBERSHIP RENEWAL & MEMBERSHIP UPGRADE

Invitations to renew or to upgrade membership are issued at our sole discretion. All artists are subject to a renewal / upgrade review process. We reserve the right to make non-standard renewal and/or upgrade offers depending on individual circumstances.

PRICES AND AVAILABLITY

All prices for membership subscriptions are in Pounds Sterling (£).

Prices, special offers and availability information are subject to change without notice. You will be advised of any changes to price, special offers and availability when you place an item in your shopping basket before you make a purchase.

PAYMENT

CREDIT/DEBIT CARD (ON-LINE PAYMENT)
All on-line orders will be processed in a secure environment through PayPal. Please click here to view PayPal's website. Through the service of PayPal you can use any of the following credit and debit cards to make on-line payment: Visa/Delta/Electron, MasterCard/EuroCard, Discover, American Express, Switch and Solo.

CHEQUES (OFF-LINE PAYMENT)
Cheques should be made payable to 'Mini Gallery' and be in Pounds Sterling (£) from a UK bank.
Please print your name and address on the back of the cheque.

ORDERS

ONLINE
When you place an order online for membership subscription , you will have the opportunity to check the details of your order and correct any errors before placing the order. When you place your order you are making an offer to buy. You will be sent an e-mail (“ACKNOWLEDGEMENT OF ORDER”) confirming receipt of your order from PayPal. The ACKNOWLEDGEMENT OF ORDER is not acceptance of your offer. If your offer has been accepted you will be contacted by us via e-mail confirming the details of your order (“ORDER CONFIRMATION”). At this time your offer to buy will have been accepted and a legally binding contract will be formed and your membership subscription will commence.

OFFLINE
If you would like to make an order for membership subscription and pay offline, send the order form to Mini Gallery, 4 Bassett Court, Bassett Avenue, Southampton, SO16 7DR. The order form can be found at http://www.minigalleryworld.com/orderform.asp. When you send this order form you are making an offer to buy. You will be sent an e-mail or letter (“ACKNOWLEDGEMENT OF ORDER”) confirming receipt of your order. The ACKNOWLEDGEMENT OF ORDER is not acceptance of your offer. If your offer has been accepted you will be contacted by us via e-mail or letter confirming that your offer has been accepted (“ORDER CONFIRMATION”).

At this time your offer to buy will have been accepted and a legally binding contract will be formed and your membership subscription will commence.

ORDER CONFIRMATION

Your order confirmation e-mail or letter will provide the following information:

• order reference number
• your name and address
• date of order
• details of membership subscription
• total price paid

CANCELLATION

If you cancel your membership subscription within one (1) month of the commencement of your subscription you shall receive a full refund of your subscription fee. You shall not be entitled to a refund if you cancel your subscription after one (1) month from the commencement of your subscription.

CHANGES TO THE TERMS & CONDITIONS

We reserve the right to change the Terms & Conditions from time to time, and post a new version on our website. The new version will take effect from the time of posting on the site.

WARRANTY

You warrant that the artwork and products you submit to and display in your individual Mini Gallery on www.minigalleryworld.com is your own original work and such artwork or products do not infringe the copyright or other intellectual property rights of any third parties.

INDEMNITY

You undertake to indemnify and hold us harmless from any claims, damages, expenses (including legal fees) incurred by us and arising out of or in connection with your artwork or products, activities or the content of your individual mini gallery, including, without limitation, any actual or alleged infringement of copyright or other intellectual property rights.

You undertake to indemnify and hold us harmless from any claims, damages, expenses (including legal fees) incurred by us and arising out of or in connection with any transactions carried out between you and your customers.

LIABILITY

We are not responsible for and to the fullest extent permitted by law exclude all liability for any losses or damages arising from or in connection with your individual mini gallery, directory entry or your activities.

We will not be liable for any loss of revenue, profits, data, indirect, special, consequential damages arising in connection with this agreement, even if we have been advised of the possibility of such damages or if such damages were reasonably foreseeable at the date of this agreement.

DISCLAIMER

We make no representation that the operation of our website (www.minigalleryworld.com) will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or down time. We make no representation regarding the compatibility of your computer when used to access our website.

MISCELLANEOUS

In the event we are unable to comply with our obligations due to circumstances beyond our reasonable control, we shall not be liable for such inability to comply with our obligations or resulting delays.

These terms and conditions are governed by the laws of England and Wales. Any dispute shall be submitted to the exclusive jurisdiction of the English Courts.

All transactions in relation to these terms and conditions will be conducted in English.

This contract will not be filed.
